Effective date: September 28, 2026. These Terms govern your access to and use of the Bougie Booking website and any purchases or services obtained through it.

Welcome to Bougie Booking, a division of Backyard Bougie, Inc. ("Bougie Booking," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of bougiebooking.com, including each venue’s booking pages at addresses ending in .bougiebooking.com (the "Website") and any purchases or services obtained through the Website.

Section 1
Use of Website
You agree to use the Website only for lawful purposes. You may not use this Website to engage in fraudulent, abusive, illegal, or harmful activity. We reserve the right to suspend or terminate access to users who violate these Terms.
Section 2
Intellectual Property
All Website content, including but not limited to text, graphics, logos, designs, product images, digital downloads, and branding elements, is the property of Backyard Bougie, Inc. and is protected under applicable intellectual property laws.
You may not reproduce, distribute, modify, or exploit any content without prior written permission.
Content a venue supplies for its booking pages, such as its name, logo, event descriptions, and photographs, belongs to that venue or its licensors.
Section 3
Product Information
We strive to display accurate product descriptions, pricing, and availability. However, we do not warrant that all information is error-free.
We reserve the right to:
- Correct errors
- Change pricing
- Modify product descriptions
- Cancel orders due to inaccuracies
Event details, prices, and table and seat availability shown on a venue’s booking pages are set by that venue.
Section 4
Order Acceptance and Cancellation
We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to:
- Product availability limitations
- Pricing errors
- Suspected fraudulent transactions
Orders are not considered accepted until payment is processed and confirmed.
A booking is an order placed with a venue through the Website. Once a booking is confirmed, you can change the name on it or cancel it using the manage link in your confirmation email. What is refunded when a booking is cancelled is set out under Cancellations & Refunds below.
Section 5
Pricing and Payment
All prices are listed in U.S. Dollars. Payment must be received in full prior to processing and fulfillment. Payment is made by card through Stripe, a secure third-party payment processor, into the venue’s own Stripe account. We do not store full credit card information on our servers.
Bougie Booking sells bookings on behalf of each venue. The venue is the seller and the merchant of record for your booking: your payment is made to the venue, and the venue is responsible for the event itself, for sales tax, and for refunds and disputes. The total shown before you pay includes a per-person booking fee. The booking fee is Bougie Booking’s fee for the booking service and is the only part of your payment that Bougie Booking receives.
Section 6
Cancellations & Refunds
Cancellations and refunds follow the venue’s cancellation policy, which is shown before you pay and which you accept at checkout. Refunds are made by the venue, through Stripe, to the card you paid with.
If you cancel a booking, the booking fee is not refunded. If the venue cancels your booking, your payment is refunded in full, including the booking fee.
Section 7
No Warranties
All products and services are provided "as is" and without warranties of any kind, either expressed or implied, including merchantability or fitness for a particular purpose.
Section 8
Limitation of Liability
To the fullest extent permitted by law, Backyard Bougie, Inc. shall not be liable for indirect, incidental, special, or consequential damages arising from:
- Website use
- Product purchase
- Service interruptions
Our total liability shall not exceed the amount paid for the specific product or service in dispute.
For a booking, the amount paid to Bougie Booking is the booking fee; the rest of your payment is paid to the venue.
Section 9
Indemnification
You agree to indemnify and hold harmless Backyard Bougie, Inc. from any claims, damages, liabilities, or expenses arising from your violation of these Terms.
Section 10
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Section 11
Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted with a revised effective date. Continued use of the Website constitutes acceptance of any updated Terms.
